Chongqing Yanken Trading Co., Ltd. participated in the “Children's Health Equipment Purchasing†project of Chongqing Municipal Health Planning Commission. Due to the provision of false sales contracts, it was awarded a fine of RMB 6,500 by the Chongqing Municipal Finance Bureau and included in the list of bad behavior records within one year. Administrative penalties for participation in government procurement activities are prohibited.
This is a typical case of providing false bidding materials. It is worth noting that Chongqing Yuken Trading Co., Ltd. and its related behaviors have also been included in the “Government Procurement Serious Illegal and Untrustworthy Behavior Information Record†(hereinafter referred to as the “blacklist†of government procurement).
The “blacklist†was initiated by the Ministry of Finance in 2014 and designated to publish a comprehensive record of serious illegal and untrustworthy behaviors in government procurement on the Chinese government procurement network. After reviewing the “blacklistâ€, Cypress's equipment found that there are more than 240 information records of untrustworthy behaviors in the company, of which 34 are related to medical equipment procurement.
The medical device companies that have been included in the “blacklist†of government procurement have concentrated on two aspects: collusive bidding; fraud in bidding documents and seeking to win the bid. As for the way of fraud, there are many tricks, such as official seal fraud, contract fraud, social security payment vouchers, concealing real prices, and so on.
For medical device companies, once they enter the “blacklistâ€, they face fines and prohibition from participating in government procurement activities.
In addition, in addition to achieving national interconnection within the political procurement system, the Ministry of Finance will also provide a “blacklist†to the e-government extranet and the “credit China†website for sharing by various government departments. That is to say, the “blacklist†is shared by multiple departments, and joint disciplinary measures can be implemented.
